Greenberg Traurig’s Employee Safety and Health: OSHA Litigation & Counseling Team advises and defends employers in a myriad of industries across the country regarding workplace safety and health issues. We understand how workplace safety and health frequently interacts with other areas of the law, including labor, employment, construction, environmental, civil, and criminal law. Our team includes the former General Counsel of the federal Occupational Safety and Health Review Commission, the agency in charge of adjudicating workplace safety and health disputes between the Occupational Safety and Health Administration (OSHA) and employers.

With 29 U.S. offices, the GT OSHA team can assist in virtually any location. The team has litigated thousands of OSHA citations across the country, ranging from small routine matters to some of the most complex and novel workplace safety and health cases. We have represented hundreds of employers who have had injuries, illnesses, amputations, fatalities, and catastrophic events in the workplace. We assist defense counsel in civil and criminal defense proceedings where workplace safety and health is a central issue in the case. We also represent employers in response to OSHA issuing press releases after an inspection as well as placing employers into the Severe Violator Enforcement Program.

To help minimize the risks associated with litigating workplace safety and health-related issues in the administrative, civil, and criminal context, the GT OSHA team proactively works with employers to establish and maintain a strong workplace safety and health culture within the business. Our team assists employers in developing plans to manage OSHA inspections; investigate injuries, illnesses, amputations, fatalities, and catastrophic events in the workplace; and conduct workplace safety and health audits under attorney-client privilege. We also represent employers in the event an employee makes a whistleblower retaliation complaint to OSHA, claiming that they suffered an adverse employment action due to the employee raising safety concerns with management. Our team also conducts workplace safety and health due diligence reviews for employers when they are considering acquiring or merging with another business entity.
