Tax Hurdles on Equine Acquisitions

Greenberg Traurig Shareholders Erik de Bie and Glenn Newman presented on how state and local sales and use taxes can be traps for the unwary when purchasing or selling horses and how each tax authority has its own exemptions and rules for imposing sales and use taxes. With the elimination of the requirement to have physical presence in the state for sales tax purposes after the U.S. Supreme Court decision in Wayfair, the potential exposure to sales and use tax in one or more jurisdictions is even more important to understand. They also addressed European Union Value Added Taxes (“VAT”) for international transactions.
