Greenberg Traurig Releases Episode 13 of the Trade Secret Law Evolution Podcast: “Lettuce, Baseball, and Circumstantial Evidence”

LOS ANGELES – Dec. 5, 2019 –Global law firm Greenberg Traurig, LLP released Episode 13 of its Trade Secret Law Evolution Podcast titled “Lettuce, Baseball, and Circumstantial Evidence.”

Co-hosted by Greenberg Traurig Shareholder Jordan D. Grotzinger and Associate Kevin J. Cole, Episode 13 explores what constitutes a trade secret and how it can be a combination of public and proprietary elements. Grotzinger and Cole also address the value of circumstantial evidence in the featured cases.

Select takeaways:

  • Trade secrets can be combinations of elements, like ingredients and processes. Disclosure of just one, without the other, will not destroy their secrecy.
  • A trade secret can include public elements, but if they are combined with secret elements, the combination can constitute a trade secret.
  • Circumstantial evidence can be valuable in trade secret cases and can support injunctive relief. Consider, for example, whether Defendant’s conduct makes any sense if Defendant was not misappropriating trade secrets. If not, that is circumstantial evidence of misappropriation.

The Trade Secret Law Evolution Podcast is designed to help business leaders, in-house counsel, and entrepreneurs stay current on trade secret law, to help them protect their companies’ most valuable assets. Each episode addresses recent developments in the law and concludes with key takeaways. The podcast is available on the Greenberg Traurig website, as well as on Apple Podcasts, Stitcher, and Spotify.

The Trade Secret Law Evolution Podcast was created by Grotzinger, who co-chairs Greenberg Traurig’s Los Angeles Litigation Practice. Grotzinger is a business trial lawyer focusing on trade secret law, consumer class action defense, financial services, and entertainment litigation in federal and state courts.
