NEW YORK and PHILADELPHIA – Dec. 3, 2021 – Global law firm Greenberg Traurig, LLP released a new episode of the E2 Law Podcast titled “The New Environmental Rights Amendment to the NY Constitution.”
In this first episode of the 2022 Evolving Environmental Law miniseries, Shareholders Steven C. Russo and David G. Mandelbaum discuss the recently enacted Environmental Rights Amendment to the New York Constitution, which will go into effect in Jan. 2022. Although it is a short provision, the Amendment leaves many unanswered questions about the potential impact for New Yorkers. Mandelbaum, based in the firm’s Philadelphia office, discusses a similar provision in Pennsylvania that has been in effect for about 50 years and whether it provides a potential guide for how the New York law may be interpreted and enforced.
Russo chairs the firm’s New York Environmental Practice. He focuses his practice on environmental law and litigation, environmental permitting, National Environmental Policy Act (NEPA), State Environmental Quality Review Act (SEQRA) review, toxic tort litigation, environmental crimes, Brownfields redevelopment, government, energy, and the environmental aspects of land use and real estate law. He is equally experienced litigating in federal and state courts as well as counseling his clients with regard to environmental liability risk and due diligence, permitting, Brownfields, and impact assessment and review. Russo also practices election and campaign finance law.
Mandelbaum represents clients facing problems under environmental laws. He regularly represents clients in lawsuits and has helped clients achieve satisfactory outcomes through regulatory negotiation or private transactions. A Fellow of the American College of Environmental Lawyers, Mandelbaum teaches Superfund and Oil and Gas Law in rotation at the Temple University Beasley School of Law as well as an environmental litigation course at Suffolk (Boston) Law School.
