Elayna M. Fiene represents clients in commercial disputes. She manages, directs, and engages in all stages of litigation, including drafting pleadings, discovery, and dispositive motions, taking and defending depositions, working closely with experts to develop expert reports, and preparing cases for trial. She negotiates settlements for clients, including matters with multimillion-dollar exposure, and routinely appears in state and federal court.

Elayna has significant experience representing national insurance companies in high-exposure bad faith cases in Colorado. Elayna also handles appeals as well as products liability and construction defect matters.

Capabilities

Experience

  • Obtained jury verdict in favor of client on all claims and counterclaims as second chair attorney in federal jury trial. Jury verdict included first known verdict in Colorado for counterclaim for breach of contract’s appraisal clause.°
  • Won complete affirmance in the Tenth Circuit of summary judgment in favor of an insurance company resulting in dismissal of breach of contract and bad faith claims.°
  • Settled multiple cases with exposure in the hundreds of millions of dollars, including some on a “walk-away” basis.°
  • Obtained settlement of bad faith claims on the eve of trial for an international insurance company related to a denial of coverage on a construction policy.°
