Amber J. Münck

Amber J. Munck is a trial attorney with experience in virtually all aspects of complex class action and commercial litigation. She focuses her practice on a wide range of employment and business matters, including the defense of wage and hour class and collective actions and discrimination claims, as well as a broad range of business torts, real estate disputes, contracts and statutory claims.

Amber’s employment practice involves counseling and representing employers with regard to their compliance with federal and state wage and hour laws, including the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), Title VII of the Civil Rights Act of 1965, the American with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), the Colorado Wage Claim Act, Colorado Minimum Wage Act and Wage Order Number 24, and Colorado’s Family Medical Leave Act, among others. She has defended employers in litigation involving claims of discrimination, harassment, retaliation, and wrongful termination, among others. Amber appears regularly in federal and state courts in Colorado and across the country, and defends employers against charges filed with the Equal Employment Opportunity Commission, the Colorado Civil Rights Division, and the Colorado Department of Labor. She recently acted as coordinating counsel in the defense of more than 70 class and collective actions nationwide for a Fortune 5 company. Amber represents other companies in the retail, restaurant service, automotive, logistics and consumer electronics industries, among others.

Amber advises and trains management and in-house counsel on a broad spectrum of employment issues, with an eye toward avoiding litigation altogether, including in the areas of hiring, firing, harassment, diversity, misconduct, leave and attendance, employee accommodations, employment and severance agreements, executive contracts, independent contractors, internal investigations, background checks, and employee handbooks and policies. She counsels clients on developing and enforcing best in class policies, employee handbooks, and employment and compensation agreements.

  • Acted as lead counsel for an international multibillion-dollar publicly traded company in connection with a real estate development and lien dispute.
  • Counseled companies on various aspects of employment law, including employment agreements, restrictive covenants, employee handbooks, separation agreements and administrative proceedings.
  • Commercial litigation in both state and federal courts, including jury trials, bench trials, dispositive motions, arbitrations and appeals.
  • Represented private and public entities in connection with litigation and counseling with respect to employment matters arising under Title VII, FMLA, ADA, and state wage and hour and anti-discrimination statutes.
  • Assisted with the handling of trademark infringement actions, trademark dilution actions, and trademark opposition and cancellation proceedings for a leading international real estate brokerage company.
  • Assisted in the defense of a former high-ranking Enron executive in his white collar criminal trial and in numerous civil proceedings. Work as the trial and courtroom logistics manager for the team, was featured in the Houston Chronicle and The Wall Street Journal. Involved with pre-trial discovery and motion practice and assisted on all aspects of the trial, from argument to witness preparation to witness examination.
  • Member of trial team for a Fortune 500 international entertainment and media company in the longest running dispute in Los Angeles County, arising out of the company's licensing and merchandising rights of a well-known cartoon character. Developed and briefed complex legal arguments, including one that helped secure a judgment of dismissal following a trial of a motion for terminating sanctions.
  • Assisted in the defense of a global media and technology company in a multi-pronged patent infringement suit regarding the way in which television scheduling information and programs are delivered to a viewer, manipulated by the viewer and watched on the screen.
  • Defended on appeal a judgment of dismissal against an individual alleging antitrust price fixing claims by a Fortune 500 entertainment company.
  • Handled a number of matters, ranging from mediations, to plaintiffs' cases, to malpractice suits.
