Greenberg Traurig Of Counsels Stephen Edmundson and Justin Bernstein will present "Use of TRCP 91a (Baseless Dismissal) and TCPA (Texas Citizens Participation Act): The Basics, Key Cases & Practice Tips" virtually for The Woodlands Bar Association virtual CLE program. They will discuss the basics elements of Tex. R. Civ. P. 91a (what it is, what it isn’t, when to use it, mandatory inclusions, timing requirements, effects of amendments and withdrawals, basic procedural issues, attorney fees provisions, and appeals). In addition, the presentation will touch on the rule’s 2019 amendment and escalated use, as well as key/representative cases and practice tips. The second half of the presentation will focus on The Texas Citizens Participation Act (Tex. Civ. Prac. & Rem. Code §§ 27.001-27.011). TCPA has spread far beyond its First-Amendment roots to become a reliable shield in routine commercial litigation. It will also discuss when and how to effectively use the TCPA to dismiss claims, and recent amendments to the TCPA, key cases applying the TCPA, and advantages of the TCPA over other dismissal tools.
