Insurer's $1M Award To End 16-Year Contract Dispute

Zenith Insurance Co. has won a nearly $1 million jury verdict in Florida state court bringing to end a 16-year-old contract dispute over a worker's compensation policy held by the drive-thru Farms Stores convenience store chain.

Following a 6-day trial and two hours of deliberation, a jury in Miami-Dade circuit court returned a verdict Nov. 17 in favor of Zenith's counterclaims for breach of contract and breach of fiduciary duty based on claims of unpaid premiums. The jury awarded Zenith more than $927,000, a total the insurer's counsel said in a statement will likely almost double when interest is calculated.

Zenith is represented by David O. Batista, Bill Spivey, Julissa Rodriguez, Sara Levy and Stephanie Varela of Greenberg Traurig PA, Sara Levy and Thomas Valentine of Walters Levine Klingensmith & Thomison.
