Jamie R. Adams represents clients in labor and employment suits in state and federal court. In the area of traditional labor law, Jamie represents management in collective bargaining negotiations, arbitrations, and unfair labor practice proceedings before the National Labor Relations Board.

Jamie also counsels clients in day-to-day employment matters. She routinely consults with human resources professionals, executives, and board members regarding all aspects of the employment relationship, including hiring and firing practices, employment contracts, enforceability of covenants not to compete, and reductions in force. She often advises foreign and out-of-state companies with a California presence on unique California-related employment issues.

Experience

  • Represented a hotel owner and hotel management company in a wage and hour class action in California. The case included allegations of failure to comply with a living wage ordinance and service charge ordinance, unpaid overtime, meal and rest break violations, off-the-clock work and unreimbursed expenses.°
  • Represented a medical waste services company in a wage and hour class action in California, which included allegations of off-the-clock work related to rounding and doffing.°
  • Represented residential care facility in wage and hour suit in California federal court that involved sleep time allegations under the FLSA.°
  • Represented an energy company in a test-of-certification case and multiple unfair labor practice charges before Region 20 of the NLRB. After briefing before the D.C. Circuit, the parties agreed to resolve the charges and IBEW disclaimed interest in the bargaining unit.The Board granted a petition to revoke the certification of the union as the employees’ representative.
  • Represented an acute care hospital in unfair labor practice charge before Region 28 of the NLRB. Charge alleged that employee was terminated in retaliation for her union activity. The Regional Director found no merit to the allegations and the union withdrew the charge in lieu of dismissal.
  • Represented a hotel management company in several unfair labor practice charges filed in Region 31 in connection with a UNITE HERE Local 11 organizing drive.Charges alleged that employees were disciplined and terminated in retaliation for their protected, concerted activity. Pursued charges against union for coercion and secondary boycott.°
  • Trained managers for a cruise and event company to properly investigate harassment and discrimination claims under California and federal law.
  • Provided anti-harassment training for supervisors for a California winery.
  • Assisted employers with investigating employee misconduct and evaluating grievance issues.Advised regarding discipline and termination decisions in connection with employment contracts and collective bargaining agreements. Drafted and negotiated severance agreements.
  • Advised employers regarding worker classification questions under California law and the FLSA.
  • Drafted multiple executive compensation agreements for entertainment and nightlife company.
  • Drafted employee handbooks, employment policies, and nondisclosure agreements.
