Michael H. Imbacuan focuses his practice on patent litigation in the pharmaceutical and chemical arts, and has more than 15 years of experience litigating patent cases arising under the Drug Price Competition and Patent Term Restoration Act (Hatch-Waxman cases). Michael also advises clients on matters relating to the Hatch-Waxman Act and other regulatory issues, as well as in the development of strategic plans to bring pharmaceutical products to market.

  • Reckitt Benckiser v. Dr. Reddy’s Laboratories Ltd., et al. – represented Dr. Reddy’s in an ANDA case in the District of New Jersey involving a generic version of Mucinex® D (guaifenesin/pseudoephedrine HCl); obtained judgment of non-infringement following bench trial. °
  • Merck Sharpe & Dohme Corp. v. Amneal Pharmaceuticals LLC – represented Amneal in an ANDA case in the District of Delaware involving a generic version of Nasonex® (mometasone furoate) nasal spray; obtained judgment of non-infringement following bench trial. °
  • Astrazeneca UK Ltd. et al v. Dr. Reddy’s Laboratories, Ltd., et al. – represented Dr. Reddy’s in an ANDA case in the District of New Jersey involving a generic version of Accolate® (zafirlukast); obtained summary judgment of non-infringement. °
