Brian H. Koch is a shareholder in the firm's Fort Lauderdale Litigation Practice and has a diverse commercial litigation practice. Brian has represented regional, national and international clients in state and federal courts. Brian routinely litigates partnership and shareholder disputes, insurance disputes, employment disputes and contract related issues. Representing both plaintiffs and defendants, Brian has broad experience handling all aspects of litigation including motion practice, trial and appeals.

Experience

  • Represented Fortune 500 company, its former General Counsel, and former Human Resources Vice President in three-week jury trial for alleged disability discrimination and defamation, which resulted in complete defense verdict on all claims where plaintiff had sought in excess of $8 million in damages (April 2019).
  • Obtained injunction for real estate company in enforcement of non-compete agreement, affirmed on appeal, Kings Point Signature Real Estate Company LLC v. Gibson, 2018 WL 6575517 (Fla. 4th DCA Dec. 13, 2018).
  • Lead counsel for contractor in obtaining arbitration award enforcing multimillion-dollar contract, and securing full payment following award (2018).
  • Defended major title insurer against alleged contract, tort and constructive fraud claims seeking $35 million in damages, obtaining summary judgment in favor of the title insurer on all pending counts and having judgment affirmed on appeal, 2014 WL 2917052 (Fla. 2d DCA June 27, 2014).
  • Represented client in jury trial in the Southern District of New York, obtaining a $5 million verdict in client’s favor in complex insurance dispute.
  • Represented Alcoa Inc. and Reynolds Metals Corp. in trademark infringement case filed in the District of Puerto Rico. Matter settled shortly after the U.S. Magistrate Judge issued a report recommending injunctive relief in favor of Alcoa and Reynolds.
  • Represented Fields BMW in defense of preliminary injunctive relief sought by automobile wholesaler in the District of Puerto Rico. After evidentiary hearing, preliminary injunctive relief was denied. See Prime Wholesalers, Inc. v. Fields Motorcars of Florida, Inc., 2009 WL 2612519 (D.P.R. August 17, 2009).
  • Representation of America's largest fragrance distributor in jury trial concerning breach of contract and equitable claims.
  • Represent numerous clients in landlord/tenant litigation, including evictions, damage claims, lease issues and fine disputes.
  • Prosecuted and defended shareholder and partnership disputes.
  • Represents clients in federal and state courts concerning property insurance and life insurance disputes.
  • Obtained injunctions on behalf of multiple clients in trademark infringement suits. See, e.g., Park ‘N Fly Service Corp. v. Airport Parking, Inc., No. 0:12–cv–60389–RNS, 2012 WL 1949361 (S.D. Fla. Apr. 27, 2012).
  • Defended placement of constitutional amendment on ballot for Florida's November 2004 general election, 880 So. 2d 636 (Fla. 2004).
  • Represented asset management company in full collection of millions of dollars in distressed loans purchased from FDIC.
  • Represented land developer in defense of toxic tort litigation involving more than 50 plaintiffs.
  • Represented large real estate company as lead counsel in enforcement of non-compete agreement, obtaining final injunctive relief.
