Bradly A. Nankerville


Bradly A. Nankerville is an experienced litigator in state and federal courts in Pennsylvania, New Jersey, and other jurisdictions around the country. Brad focuses his practice on complex commercial and employment litigation and has handled cases on behalf of clients in a range of industries, including real estate, banking, energy, education, pharmaceutical, and retail. He has experience at all stages of litigation, at both trial and appellate levels, representing both plaintiffs and defendants. On the commercial side, Brad has handled major contractual disputes involving service agreements and purchase and sale agreements and has defended businesses from consumer class actions and claims under a variety of state and federal statutes, including the Securities Exchange Act and Real Estate Settlement Procedures Act. His commercial cases often involve unique regulatory issues, such as rarely litigated financing from government entities and administrative rulings on railroad consolidations. On the employment side, Brad has litigated individual and putative class and collective actions under employment agreements and many of the key statutes impacting businesses today, including the Americans with Disabilities Act, Rehabilitation Act, Fair Labor Standards Act, Pennsylvania Minimum Wage Act, and Title VII. Beyond his litigation practice, Brad has reviewed and revised institutional policies for regulatory compliance, has advised other litigators in high-stakes appeals, and has assisted a former federal judge in managing and resolving numerous arbitrations. A former pollster and research assistant to a prominent Pennsylvania political analyst, Brad also has a keen sense of the state political landscape and even advised the current administration on Pennsylvania’s moratorium on the death penalty.

  • Obtained complete dismissal of claims against private alternative school for violation of Americans with Disabilities Act, Rehabilitation Act, and state tort law.
  • Obtained order protecting real estate developer from pre-complaint discovery requests, resulting in abandonment of proposed fraud claim.
  • Defended loan servicer in numerous cases in state and federal court, at trial and appellate levels, from mortgage-related claims, including for violation of Real Estate Settlement Procedures Act.
  • Defended major retailer in putative class and collective action under Fair Labor Standards Act and Pennsylvania Minimum Wage Act.
  • Completed extensive Title IX compliance policy review for 14 Pennsylvania universities.°
  • Defended bank in action by former CFO for breach of employment agreement and violation of the Pennsylvania Wage Payment and Collection Law, resulting in settlement after one day of trial.°
  • Defeated three attempts at class certification in action against health information management company for violation of New Jersey medical records copying law.°
  • Obtained $4.4 million, pre-discovery summary judgment for global energy company in action for breach of contract and account stated.°
  • As appellate consultant, advised pharmaceutical company and rail carrier in appeals before Eleventh and Sixth Circuits, in actions for violation of Securities Exchange Act and breach of trackage rights agreement.°
  • Represented real estate developer in dispute over multi-million dollar acquisition of apartment complex financed in part by novel “Capital Advance” from U.S. Department of Housing and Urban Development.°
  • Assisted former Third Circuit judge in managing and resolving complex commercial and employment arbitrations before the American Arbitration Association and elsewhere.°
  • Represented Salvadoran national in petition for review before Third Circuit, obtaining complete dismissal of administrative removal order based on two alleged aggravated felonies and relief from deportation.°
  • Advised Governor Tom Wolf’s transition team on legal aspects of Pennsylvania’s moratorium on death penalty.°
