Eliot Pedrosa is an experienced litigator with first-chair trial and arbitration experience in financial, commercial, products liability and international cases. Eliot represents local, national and international clients in litigation and trials before judges and juries throughout Florida’s state and federal courts, as well as in arbitrations administered by domestic and international organizations. Eliot also frequently counsels clients engaging in business transactions on litigation and dispute resolution offering his clients value as both a counselor and advocate. 

Currently Eliot chairs the firm’s 40-member Miami Litigation Department and previously served as Hiring Shareholder for the Miami office of the firm.

  • Defended national bank in action brought by 22 victims of Ponzi scheme seeking to hold four separate national banks responsible for losses; argued motions to dismiss on behalf of all four bank defendants, resulting in dismissal of all claims against all bank defendants, affirmed on appeal.
  • Defended national bank in action by borrower asserting claims for breach of contract and negligent misrepresentation, resulting in dismissal of all claims.
  • Defended national bank in its capacity as indenture trustee in arbitration, state court and federal court actions brought by significant noteholder, resulting in arbitration award in favor of the bank, dismissal of the state court action, and nuisance-value settlement of the federal court action.
  • Represented national insurance company in pursuit of RICO claims against insured professional employer organization and 30 affiliated individuals and entities arising out of fraudulent scheme involving the manufacture of forged letters of credit, resulting in multiple civil judgments, criminal convictions, and recovery of tens of millions of dollars.
  • Represented national loan servicing company in multiple residential mortgage foreclosure actions.
  • Represented international brokerage firm on a claim for breach of contract by the estate of a former client, resulting in dismissal of all claims.
  • Represented national bank in a civil action arising out of the theft of millions of dollars in valuables from safe deposit boxes.
  • Represented national bank in action seeking recovery of funds stolen by bank customer using false identity.
  • Represented national insurance company in pursuit of large receivables owed by multiple professional employer organization clients following insurance company’s exit from the business line, resulting in negotiation of multiple settlements.
  • Represented Applica Incorporated in defense of a lawsuit in the Delaware Chancery Court arising out of a public company merger.
  • Represented real estate investor in an arbitration by a former joint venture partner, resulting in a dismissal of all claims.
  • Represented individuals and entities in multiple SEC enforcement investigations.
  • Represented individuals and entities in multiple civil enforcement investigations by Florida Office of the Attorney General.
  • Represented foreign sovereign in claim brought by foreign sales agent for indemnification arising out of sale of arms in Latin America, resulting in dismissal of all claims pursuant to the Foreign Sovereign Immunities Act.
  • Represented Israeli laboratory management software company in defense of arbitration claims brought by Canadian pharmaceutical company, resulting in an arbitration award on all claims.
  • Represented Nicaraguan sugar producer in arbitration claims under UNCITRAL Arbitration Rules, resulting in an arbitration award.
  • Represented Central American infrastructure construction company in defense of merger claims brought by acquirer, resulting in favorable resolution via pre-suit ADR.
  • Represented the world's largest fragrance company in disputes with former Latin American distributors, resulting in dismissal of all claims against the company and favorable settlement of counterclaims against the distributors.
  • Represented Spanish media company in defense of unfair competition and tortious interference claims by a competitor in the Spanish-language radio business.
  • Represented international salsa music record label in the defense of copyright and commercial claims by artists, resulting in a favorable resolution of all claims and restructuring of artist contracts.
  • Lead trial counsel for Lorillard Tobacco Company in multi-week federal jury trial before the United States District Court for the Southern District of Florida, resulting in a defense verdict.
  • Lead trial counsel for Lorillard Tobacco Company in actions throughout Florida state courts, including several multi-week jury trials in Miami-Dade, Broward, Escambia and Hillsborough counties.
  • Lead arbitration counsel for national bank in its capacity as indenture trustee in defense of bondholder claim, resulting in an arbitration award in favor of the trustee.
  • Lead arbitration counsel for Israeli healthcare software company in arbitration brought under the AAA Commercial Arbitration Rules by Canadian pharmaceutical company, resulting in an arbitration award on all claims.
  • Lead arbitration counsel for Nicaraguan sugar producer in arbitration claims under UNCITRAL Arbitration Rules, resulting in an arbitration award.
