John P. Sullivan, Jr. is a member of the Intellectual Property & Technology Practice in Greenberg Traurig's Philadelphia office. John serves a range of clients – from emerging ventures to Fortune 500 companies – and focuses on delivering pragmatic legal approaches to a host of complex intellectual property and corporate law issues. His distinctive knowledge and strategic capabilities in the realm of both litigation and transactional legal counsel often dovetail into one another, benefitting his clients.

With a background in music and entrepreneurship, John combines his business acumen and legal knowledge to help clients identify, protect, commercialize, and enforce their brands, creativity, and technological innovations. As an entrepreneur prior to becoming an attorney, John experienced first-hand the legal maze that must be navigated to successfully launch and scale a venture. His strong knowledge of trademark and copyright law, commercial licensing, and corporate strategy helps clients develop and implement pragmatic business approaches to complex intellectual property and corporate law problems. John’s practice often crosses traditional practice area boundaries, as he understands that an increasingly complex, globally interconnected economy means a legal issue rarely pertains to just one area of law. As a dual Irish citizen with considerable experience counseling companies coming out of or expanding into the European market, John provides clients a valued international perspective. He regularly represents both U.S. and European clients looking to implement or scale trans-Atlantic operations. John’s highly respected position in both the U.S. and Irish legal and business communities allows him to offer unique insights and legal counsel informed by years of experience living and doing business in both Europe and the United States.

His substantial experience managing global trademark portfolios for clients includes wide-ranging perspectives from leading negotiations for numerous commercial licensing, brand licensing, and software licensing deals. On the enforcement side, John’s background also includes representing clients in intellectual property, unfair competition, and false advertising litigation in state and federal courts, as well as before the USPTO Trademark Trial and Appeal Board and in Uniform Domain-Name Dispute-Resolution Policy (UDRP) proceedings.

Clients also appreciate that John intimately understands the substantial role new technologies play for any business today – be those e-commerce platforms, social media, blockchain, or cryptocurrency.   • Designed, implemented, and managed customized online brand management and trademark/copyright enforcement programs for Fortune 500 clients, taking care to ensure integration of latest enforcement technologies.°
  • Represented a Caribbean-based client whose product being imported to the United States from China faced shipment seizure by U.S. Customs, which cited a lack of requisite certificates of safety testing required for children’s toys.°
    • Amid threats to destroy the shipment if the requested certificates were not provided within 24-hours, initiated a dialogue directly with U.S. Customs, arguing the adult nature of the products absolved the need for any additional testing and certification requirements.
    • Persuaded U.S. Customs with clear arguments that won immediate release of the seized shipment, enabling the company’s delivery to the originally intended retailers.
  • Led negotiations for numerous commercial licensing, brand licensing and software licensing deals.°
  • Drafted and assisted clients with implementing social media and data privacy policies and procedures.°
  • Spearheaded worldwide anti-counterfeiting program for Fortune 500 apparel company.°
  • Managed global trademark portfolios for multinational clients and led management of maintenance program for those same portfolios.°
  • Conducted IP due diligence, managed, and negotiated investment deals for angel investors and venture capital firms in the emerging venture space, including such counseling for both U.S.- and European-based investors operating in the U.S. market.°
  • Represented many U.S. companies in the evaluation of EU General Data Protection Regulation applicability to their current and future operations and to understand and modify the data processing agreements required by EU customers and vendors.°
