Elisa Hevia Baca is an associate in the firm’s Miami Litigation Practice. She concentrates her practice on complex commercial litigation matters in both federal and state courts, representing businesses in matters involving claims of consumer fraud, breach of contract, and business tort claims. She has helped clients defeat class certification and obtain summary judgments and outright dismissals prior to trial. Elisa also provides defense counsel and consulting in claims brought under Titles II and III of the Americans with Disabilities Act.

  • Defending manufacturer of water connector products in putative class action lawsuit alleging failure to warn, design defects, breach of warranty, and unjust enrichment.
  • Defending large city in putative class action lawsuit brought against it alleging violation of Title II of the ADA due to the alleged inaccessibility of the city’s sidewalks.
  • Provided defense counsel and consulting to retailers, restaurateurs, commercial landlords, and others for alleged violations of Title III of the ADA due to the inaccessibility of their stores, restaurants, and shopping centers.
  • Provided defense counsel and consulting to retailers and others for alleged violations of Title III of the ADA due to the inaccessibility of their websites and mobile apps.
  • Obtained a dismissal with prejudice for air conditioning manufacturer in a putative class action lawsuit alleging product defects and asserting warranty breaches and violation of consumer protection laws, including FDUTPA.
  • Defended international brewer and its subsidiaries in lawsuit alleging deceptive and unfair trade practices, unfair competition, and tortious interference, among other things.
  • Obtained dismissal for fashion designer in alleged tortious interference lawsuit.
