Clearing Up Confusion Around FCRA

Greenberg Traurig Shareholders James Boudreau, Dominic Draye and Christiana Signs led an online discussion on the Fair Credit Reporting Act (FCRA) on Wednesday, November 10 from 12:00 - 1:00 p.m. EST. The FCRA regulates the preparation, procurement and use of consumer reports. Routine documentation used in employment and consumer transactions falls within FCRA’s scope. With advancements in technology, these reports have become easier to obtain which has led to an increase in FCRA violation lawsuits.

Topics include:

  • The reasoning behind the FCRA and general FCRA claims
  • Unique challenges defendants face in statutory damage class action lawsuits under the FCRA and other statutory damage cases
  • The ‘remand trap’ and its potential uses and pitfalls
  • Ramirez v. TransUnion decision and its potential implications for statutory damage class actions under the FCRA and other statutes
  • State law and its interrelationship with federal law in FCRA class actions
