Insurer's $1M Award To End 16-Year Contract Dispute

Zenith Insurance Co. has won a nearly $1 million jury verdict in Florida state court bringing to end a 16-year-old contract dispute over a worker's compensation policy held by the drive-thru Farms Stores convenience store chain.

Following a 6-day trial and two hours of deliberation, a jury in Miami-Dade circuit court returned a verdict Nov. 17 in favor of Zenith's counterclaims for breach of contract and breach of fiduciary duty based on claims of unpaid premiums. The jury awarded Zenith more than $927,000, a total the insurer's counsel said in a statement will likely almost double when interest is calculated.
