Greenberg Traurig Secures Dismissal in Favor of Client, Xiaomi Inc.

AUSTIN – Sept. 2, 2021 –Shareholder Lisa Li, Of Counsel Janis E. Clements, and Associate Joseph W. Shaneyfelt of global law firm Greenberg Traurig, LLP secured a dismissal in favor of client Xiaomi Inc. in a patent case in the Western District of Texas (WDTX)-Waco. Xiaomi is a Chinese electronics manufacturer based in Beijing.

Plaintiff Cedar Lane Technologies Inc. sued Xiaomi for alleged infringement of seven of Cedar Lane’s patents directed to smartphones in WDTX. Cedar Lane’s complaint incorrectly alleged jurisdiction and venue were proper in Texas. Plaintiff’s counsel attempted to serve Xiaomi Inc. by emailing its former patent counsel after obtaining an order from Judge Alan Albright allowing alternative service in lieu of serving under the Hague Convention. Within three days of Xiaomi moving to dismiss the case for invalid service of process and lack of personal jurisdiction, Cedar Lane voluntarily dismissed the case.

“We are very pleased that we were able to help our client secure a quick dismissal utilizing the firm’s broad platform, including local expertise in Texas from Janis and Joe,” said Li, who is based in the law firm’s San Francisco office and focuses her practice on U.S. and China cross-border transactions and litigations, particularly in matters involving technology companies, manufacturers, and real estate.

Clements, resident in the Austin office, focuses her practice on patent litigation, intellectual property licensing, commercial litigation, antitrust, complex business litigation, and energy and natural resources law, with more than 20 years of experience. Shaneyfelt is also in the Austin office. He works with clients on virtually all stages of litigation from initial pleadings to final judgement and also frequently serves clients as local counsel in cases before Judge Albright.
