AUSTIN – Sept. 2, 2021 –Shareholder Lisa Li, Of Counsel Janis E. Clements, and Associate Joseph W. Shaneyfelt of global law firm Greenberg Traurig, LLP secured a dismissal in favor of client Xiaomi Inc. in a patent case in the Western District of Texas (WDTX)-Waco. Xiaomi is a Chinese electronics manufacturer based in Beijing.
Plaintiff Cedar Lane Technologies Inc. sued Xiaomi for alleged infringement of seven of Cedar Lane’s patents directed to smartphones in WDTX. Cedar Lane’s complaint incorrectly alleged jurisdiction and venue were proper in Texas. Plaintiff’s counsel attempted to serve Xiaomi Inc. by emailing its former patent counsel after obtaining an order from Judge Alan Albright allowing alternative service in lieu of serving under the Hague Convention. Within three days of Xiaomi moving to dismiss the case for invalid service of process and lack of personal jurisdiction, Cedar Lane voluntarily dismissed the case.
