Michael H. Moody focuses on complex business litigation in Florida state and federal courts and in bankruptcy courts throughout the Southeast. He represents class-action defendants, governmental agencies, and fiduciaries charged with unwinding fraud and recovering assets, as well as defending persons and entities sued by fiduciaries. Michael has a broad range of experience representing both debtors and creditors in business disputes over the payment of money in out-of-court workouts and in bankruptcy cases in each district in Florida. In addition, Michael assists entrepreneurs and small businesses grow their businesses and resolve business disputes.

  • In re C.D. Jones & Co., Inc ., Adv. Pro. No. 11-03045-KKS (Bankr. N.D. Fla. Nov. 20, 2014). Obtained summary judgment finding $1.5 million of alleged $1.75 million transfer to client was not a transfer of an "asset" that could be avoided in a fraudulent transfer action under Florida law.
  • Diquez v. Florida Department of Business and Professional Regulation, et al. (In re Diquez), 477 B.R. 257 (Bankr. S.D. Fla. 2012), Motion for Reconsideration Denied May 2, 2013 [ECF# 80] Case No. 11-02748-JKO, and Appeal of same dismissed, June 5, 2013 [ECF# 90]. Obtained dismissal with prejudice of proceeding seeking $500,000 in compensatory and punitive damages from the state of Florida Department of Business and Professional Regulation, the Construction Industry Licensing Board of the State of Florida, and two prosecuting attorneys after the debtor’s construction license had been revoked post-petition. Decision was based on Eleventh Amendment immunity, absolute prosecutorial immunity and quasi-judicial immunity.°
  • Imes v. Saxon Mortgage, et al. (In re Imes), Adv. Pro. No. 11-01225-MKN, ECF #116 (Bankr. D. Nev. April 16, 2012). Obtained dismissal of class action complaint seeking compensatory and punitive damages.°
  • In re C.D. Jones & Co., Inc., 482 B.R. 449 (Bankr. N.D. Fla. 2012). Obtained determination that claims and causes of action asserted against a litigation client in numerous forums were assets of the bankruptcy estate that could not be pursued without bankruptcy court authority, and that any proceeds arising therefrom must flow to creditors of bankruptcy estate.°
  • Harris v. Ben-Ezra & Katz, P.A. et al. (In re Harris), 458 B.R. 591 (Bankr. N.D. Fla. 2011). Obtained dismissal with prejudice of all counts of class action complaint seeking damages for alleged illegal fee splitting by law firms and mortgage processing services company.°
  • In re Cook, 454 B.R. 204 (Bankr. N.D. Fla. 2011). Obtained turnover of Chapter 7 debtor’s post-petition salary which was deemed part exempt wages and part profit distributions from stock ownership, which is property of the estate under 11 U.S.C. §541(a)(6).°
  • Heckler v. LPS Default Solutions, Inc., et al. (In re Heckler), Adv. Pro. No. 11-3022-WSS (Bankr. N.D. Fla. 2011). Obtained dismissal with prejudice of class action complaint seeking damages for alleged illegal fee splitting by law firms and mortgage processing services company.°
  • In re Robb & Stucky Limited LLP, 2011 WL 3948805 (Bankr. M.D. Fla. 2011). Obtained order disallowing administrative expense status for severance owed to CEO of company when employment contract was rejected post-petition.°
