New Episode of Greenberg Traurig’s Trade Secret Law Evolution Podcast Discusses Trade Secret Identification, Consent to Disclosure, and Sufficiency of Evidence

LOS ANGELES – Sept. 11, 2019 – Global law firm Greenberg Traurig, LLP released Episode 6 of the Trade Secret Law Evolution Podcast, titled “What Trade Secret Identification Really Means, Consent to Disclosure, and Sufficiency of Evidence.”

Co-hosted by Greenberg Traurig Shareholder Jordan D. Grotzinger and Associate Kevin J. Cole, Episode 6 explores the following key issues in trade secret law:

  • Trade secret identification involves more than just identifying the alleged trade secret, such as a customer list, algorithm, etc. It also involves supporting the elements of a trade secret, including: that it’s secret; that it’s valuable because it’s secret; and that you take reasonable steps to keep it secret.
  • There can be no misappropriation if the trade secrets owner consents to disclosure. To avoid a dispute, consent should be documented.
  • Trade secret misappropriation can be based on circumstantial evidence if such evidence supports a reasonable inference thereof. However, misappropriation cannot be based on speculative evidence. That meetings took place where trade secrets may have been discussed and a third party developed similar technology probably won’t surpass speculation.
