Jillian C. Kirn

Jillian C. Kirn focuses her practice on complex environmental and energy litigation, regulatory compliance counseling, and resolution of environmental liabilities identified in the course of transactions. She has wide-ranging experience representing clients in litigation in state and federal courts and works on behalf of developers and corporations in connection with the acquisition, sale, and financing of contaminated real estate, including environmental liability transfers. Jillian routinely assists clients with risk management matters in the context of proposed project redevelopments, renewable energy securities transactions, and legacy remedial liabilities at industrial sites.

Prior to joining the firm, Jillian handled air, waste, and toxics enforcement matters in the U.S. Environmental Protection Agency’s Office of Regional Counsel in Seattle, Washington.



  • Member of the Defense Coordination Committee for the Aqueous Film-Forming Foams (AFFF) Products Liability multidistrict litigation pending before the U.S. District Court for the District of South Carolina
  • Assistant independent monitor under an EPA debarment agreement with a major energy producer.
  • Counsel government-owned electric power company on environmental risks, legacy liabilities, and natural disaster response, in the financial restructuring of a U.S. commonwealth.
  • Represented a New Jersey power plant in a unanimous decision upholding its NJPDES permit.
  • Represented clients in a variety of industries, including electricity generation, in natural resources damages and contaminated sediment remediation matters.
  • Advised investor-owned energy companies on environmental matters arising in securities transactions related to large scale solar and wind projects in several Western states.
  • Represented clients in various industries, including midstream compression of natural gas, in wastewater, solid waste, and air permitting matters; administrative appeals; and enforcement actions.
  • Advised clients in matters involving environmental aspects of land use, such as wetlands regulation, erosion control, and brownfields.
  • Negotiated and manuscripted site-specific and portfolio environmental insurance products, including pollution, legal liability, integrated risk and contractors pollution policies on behalf of developers and corporations.
