Frederick H. Mitsdarfer, III focuses his practice on assisting with complex transactions involving the acquisition, finance, development, lease, and disposition of real estate for clients in the lender, developer, owner/operator, joint venture, corporate, and investor space. 

Fred assists clients by drafting, reviewing, and negotiating the various documents related to a wide range of commercial and industrial real estate transactions, including purchase and sale agreements, loan documents, lease agreements, easements, joint venture agreements, development agreements, security instruments, legal opinions, and other real estate related agreements, as well as helping with all facets of due diligence, including title.

Fred also represents clients in virtually all aspects of real estate development to obtain approvals, including interfacing with state and local officials. He helps clients navigate the complexities of the processes required to obtain variances and special use permits. Fred represents clients in land use and zoning matters before various commissions, boards, and other bodies to pursue necessary land development approvals.

Experience

  • Represented several lenders with various financing transactions, collectively in excess of $100 million, using commercial properties as collateral.°
  • Represented a real estate developer in the acquisition and financing of a more than 160 acre commercial parcel from an S&P 100 company.°
  • Represented a real estate developer in the acquisition and financing of numerous parcels of land from a private-public partnership for a multi-purpose arena and sports complex and the resolution of title issues related thereto.°
  • Represented multiple national title companies as local Delaware title agent on various matters.°
  • Represented a private museum in connection with the lease of a historical space to a home office.°
  • Represented a private country club in connection with a property tax assessment appeal.°
