Janna S. Nugent

Janna S. Nugent, Co-Chair of the Atlanta Business Litigation Group, is an experienced litigator, focusing her practice on complex commercial litigation and business disputes, products liability, employment matters, and tort defense. Her experience extends to both state and federal courts in Florida and Georgia, and includes representing pharmaceutical companies and medical device manufacturers in products liability cases and multi-district litigation. In addition, she represents government entities in various administrative hearings and related litigation.

  • Served on team acting as national coordinating counsel for defense of medical device manufacturer in multi-district litigation. Coordinated simultaneous discovery, preparation of briefs, and handling of expert witnesses in hundreds of cases. Assisted in bellwether trials.
  • Defended pharmaceutical companies and medical device manufacturers in state and federal cases against claims of strict liability, negligence and fraud.
  • Represented school system against a retaliation claim brought by a former employee under the whistleblower statute. The case was highly-publicized by both television and print media and involved significant discovery, motions practice and extensive pre-trial publicity. After a two-week trial, the jury returned a complete defense verdict.
  • Coordinated a multi-office team in high-profile defense of government entity’s procurement of airport concessions contracts valued at approximately $3 billion. Defeated motion for injunctive relief that would have prevented execution of contracts. Defended procurement in related administrative hearings and state court litigation.
  • Represented developer in highly contested breach of contract and specific performance action involving 22,000 acres of land valued at more than $100 million. Won complete verdict.
  • Obtained motion to dismiss all claims brought against corporation operating a chain of gasoline stations and convenience stores across the southern United States. Established precedent on enforceability of a mandatory forum selection clause in corporation’s lease and gasoline sales agreements.
  • Obtained dismissal of proposed class action lawsuit filed in the United States District Court for the Northern District of Georgia against public officials acting under Section 287(g), now codified under the Immigration and Nationality Act. Dismissal affirmed by the United States Court of Appeals for the Eleventh Circuit on July 12, 2012.
  • Served as lead counsel for public school district in administrative due process hearings demanded by tenured teachers or administrators facing non-renewal or termination of contracts.
  • Obtained voluntary dismissal with prejudice of claims brought by judicial assistant against retired judge.
  • Provided counsel to religious institution on immediate response to allegations of sexual misconduct made against a member of the clergy, and advising board members on highly contested separation of clergy, support of alleged victim and amendment of by-laws.
  • Performed numerous internal corporate investigations for various public and private clients.
