Mark E. Solomons concentrates his practice in the areas of federal administrative and regulatory law, insurance regulation, commercial insurance litigation, toxic substances injury, occupational disease compensation, health surveillance and medical records privacy programs, and related litigation. He is experienced in appellate and administrative litigation and has argued five cases before the U.S. Supreme Court. He previously served as Legislative Counsel to the U.S. Secretary of Labor and was a member of the President's Commission on Occupational Disease.

Experience

  • Designed compensation schemes for the Black Lung Trust Fund.
  • Drafted superfund provisions on the EPA’s Public Health Authority.
  • Drafted federal Black Lung Benefits Act and Longshore and Harbor Worker’s Compensation Act Regulations (LHWCA).
  • Designed a medical treatment manual for lung diseases in the coal industry.
  • Represented mining and industry interests in five cases before the U.S. Supreme Court, leading to a savings for these industries of almost $20 billion.
  • Obtained the dismissal from U.S. courts of thousands of asbestos injury claims requiring them to be pursued in arbitration in London.
  • Recovered millions of dollars from Jack Kent Cook, Inc. and the Washington Redskins for underpayment of insurance premiums for insurance coverage of the team's players.
  • Counsel of record in almost 500 cases in the U.S. Courts of Appeals.
  • Led a team challenging comprehensive regulations published on the last day of the Clinton Administration.
