Nicole Narotzky concentrates her practice on complex litigation, litigation strategy and management, and counseling on risk mitigation, including early resolution processes and procedures. Nicole’s primary focus is on product liability matters, particularly on developing and executing legal strategy related to complex and technical medical devices and regulatory issues. She has defended major medical device and pharmaceutical manufacturers in federal and state courts throughout the country in both single-plaintiff cases and in multi-district and coordinated proceedings. She has defended medical device products liability lawsuits involving a wide range of products, including diabetes management devices, neurological devices, spinal devices, and cardiovascular devices. Nicole has deep experience with the issues of federal preemption and regulatory control over claims involving FDA-approved medical devices.
Nicole also has experience litigating intellectual property, construction law, contract disputes, and health care related issues. She works closely with clients on best practices for preventative measures and risk mitigation, including those related to internal communication, responses to regulatory inquiries, and general policies and documentation.
Nicole is also committed to pro bono and community work. She has represented pro bono clients seeking domestic violence orders for protection and a client on death row in Texas. She currently represents children in the foster care system and serves on the Board of Directors for the Children’s Law Center of Minnesota. Nicole is also involved in the Minnesota legal community and serves on the Board of Directors for the Hennepin County Bar Association.

- Manage and defend claims and litigation for world-leading medical device company and oversee team in order to formulate and execute nationwide strategy to respond to and litigate claims related to a product recall; implement early resolution program and where resolution is not possible, aggressively defend each action (2013-present).
- Represented medical device client in litigation and claims relating to a coronary catheterization contrast delivery system, as well as provided counseling on risk management issues.
- Represented clients in matters related to alleged violations of the Minnesota Health Records Act.
- Eklund v. Medtronic, Inc. et. al., No. 27-CV-17-18038 (2019), Fourth Judicial District, Hennepin County, Minnesota. Argued dispositive motions, including the motion to exclude plaintiff’s expert, and won full summary judgment in a high-exposure product liability matter.°
- National counsel involved in all aspects of claims and litigation relating to voluntary recall of a medical device company’s signature product (2009-2015).°
- Defended litigation related to implanted medical devices: aggressively developed alternative causation, strategically approached discovery issues, and negotiated early settlements and dismissals (2006-2013).°
- In re Individual 35W Bridge Litigation, 806 N.W.2d 811, 806 N.W.2d 820 (2011). Represented engineering company that provided the original design for the I-35W bridge that collapsed over the Mississippi River in Minneapolis on August 1, 2007.°
- Hammitt Medtronic, Inc. (Anoka Co. D. Ct., Minnesota, (2004)). Counsel in a lawsuit involving the recall of a medical device. Case was never certified for class action and settled.°
