Will Wagner focuses his practice on the intersection of consumer products and complex scientific and environmental issues. He defends product companies against environmental consumer claims involving California’s unique Proposition 65 and consumer false advertising class actions including those based on recyclability and greenwashing. He represents companies in the personal care, fashion, food, beverage, supplement, and textile industries relating to substances of concern including heavy metals, microplastics, PFAS, phenols, benzene, and phthalates. Will also defends against more traditional deceptive advertising claims, including natural advertising, and nonfunctional slack-fill, as well as product liability claims.

Further, Will has broad experience navigating state and federal product and environmental regulations, with an emphasis on the proliferation of regulation in California. This includes work on laws that prohibit PFAS, recycling regulations (such as Extended Producer Responsibility (EPR)), and other greenwashing laws. He also has deep experience with pertinent California agencies, including the Office of Environmental Health Hazard Assessment (OEHHA), Department of Resources Recycling and Recovery (CalRecycle), Department of Toxic Substances Control (DTSC), and California Air Resources Board (CARB).

Will is also a registered lobbyist in California, focusing on legislation that impacts product companies.

  • Lead counsel for the cosmetic industry in a coordinated California action involving hundreds of lawsuits alleging violations of Prop 65 for titanium dioxide, with clients including Estee Lauder, Chanel, Shiseido, and Coty. Case concluded on dispositive motion in favor of defendants.
  • Lead counsel for the cosmetic industry in a coordinated California action involving dozens of lawsuits alleging violations of Prop 65 for DEA, with clients including Estee Lauder, Shiseido, Coty, and Edgewell. Also counsel for trade association in related First Amendment case against the State of California. Case pending.
  • Represented dozens of major restaurants and retailers in a case alleging BPS in receipt paper under Prop 65. Case resolved on an industry favorable basis.
  • Represented numerous product companies against false advertising claims related to PFAS, including Shiseido, Coty, and McDonalds. Many of these cases were dismissed on pleadings challenges.
  • Represented multiple major food companies in class action lawsuits involving the alleged undisclosed presence of lead and cadmium in products.
  • Represented major private label manufacturer in litigation in Prop 65 litigation, which resulted in complete dismissal of all claims on implied preemption grounds in a published Court of Appeal decision, Center for Environmental Health v. Perrigo.
  • Represented Personal Care Products Council, Consumer Brands Association, and California League of Food Producers in submitting an amicus brief to the Ninth Circuit on an important implied preemption issue.
  • Represented manufacturing defendants and trade association in the fiberglass industry against allegations that their facilities must provide Proposition 65 warnings for styrene. Case settled in client favorable manner.
  • Represented Bausch Health USA against claims that certain talc products required Proposition 65 warnings for heavy metal. Summary judgment granted in favor of client.
  • Represented Bausch Health USA against the claims that certain talc products were falsely advertised because they contained heavy metals and asbestos under the CLRA and UCL. Motion to dismiss granted for client. °
