• Prosecuted a fraud and breach of lease action on behalf of a global bank based upon its landlord’s scheme to pass through millions of dollars in fraudulent tax and operating expense charges under the parties’ net leases.°
• Defended a real estate investment and development firm in a RICO action brought by investors based upon allegations that firm managers concealed investment losses.°
• Prosecuted a fraud and breach of fiduciary duty action on behalf of an investor in a foreign real estate development venture based upon the project managers’ material misrepresentations concerning the scope of the project, misappropriation of investment funds, and concealment of investment losses.°
• Defended a global bank in an interpleader action brought by the IRS to resolve a claim priority dispute over the tax-debtor’s music royalty stream; the tax-debtor assigned music royalties to the bank as part of a securitization transaction; the IRS sought to set aside that securitization transaction based upon alter ego, nominee, and fraudulent transfer theories of third-party liability.°
