Rachel Kagan

Rachel Kagan is a member of the Litigation Practice and Products Liability Practice in Greenberg Traurig's Miami office. She focuses her practice on the representation and defense of medical device manufacturers, pharmaceutical companies, and consumer product manufacturers in complex products liability matters in state and federal courts throughout the country, including multidistrict and coordinated proceedings. Rachel also defends environmental toxic tort claims alleging personal injury arising from exposure to substances such as asbestos and ethylene oxide (EtO).

Rachel brings a detailed, fact-intensive approach to assessing causation issues and developing defense strategies. She analyzes medical records and the circumstances surrounding alleged injuries to evaluate causation theories, identify evidentiary weaknesses, and develop potential defenses. Rachel works closely with expert witnesses to build scientifically grounded defense positions supported by medical and technical evidence. She has substantial hands-on discovery experience, including drafting and responding to written discovery, developing defensible response strategies, and identifying key documents. Rachel leverages the factual record to support dispositive motions, prepare witnesses, and develop cohesive defense narratives that integrate complex medical and scientific issues into the broader litigation strategy.
