GT Shareholder Stacey Bosshardt is joining a distinguished panel to present to the D.C. Bar Administrative Law and Agency Practice community a timely discussion on two closely watched U.S. Supreme Court cases this term that could significantly reshape the structure and independence of federal agencies. These cases present the Court with an opportunity to reconsider longstanding "for-cause" removal protections for leaders of multi-member independent agencies such as the Federal Trade Commission and the Federal Reserve, with potentially far-reaching consequences for administrative governance.
The panel will examine what other statutory and constitutional protections for agency appointees and career staff could be vulnerable if the Court invalidates these provisions, and how such a ruling might affect an administration's ability to implement policy choices that lack broad electoral consensus. The panel’s discussion will explore the downstream implications for Americans' rights, workplace protections, and economic stability, as well as the tools available to Congress - if any - in response.
