A new F-1 visa rule scheduled to take effect on Sept. 15, 2026, could have a major impact on companies that employ students who are currently authorized to work while studying in the U.S. Finalized by the U.S. Department of Homeland Security on July 16, the rule may reduce available employment options for student employees in the U.S.
The F-1 student visa allows students to engage in off-campus employment but generally only after completion of the first academic year. However, some graduate programs allow for Day 1 curricular practical training (CPT), which allows students to work from the beginning of a qualifying academic program.
Up until now, Day 1 CPT has been used by employers as a backup or bridge option if the student worker’s future visa status is uncertain. The new rule will replace duration of status with fixed admission periods, and may require F-1 students to file for an extension of stay when they need additional time, making Day 1 CPT a less predictable backup option for employers.
