Greenberg Traurig’s Joseph J. Mamounas, Ketan M. Ganase, and Joshua M. Mandel authored a chapter for “The Guide to M&A Arbitration” published by the Global Arbitration Review on the rising frequency of M&A arbitration disputes in the United States, driven by a substantial increase in deal value in 2025. The authors analyze the legal frameworks governing these disputes, including the choice between arbitration, litigation, and expert determination, as well as the substantive law applied under Delaware and New York standards, relevant federal regimes such as the FAA, HSR Act, CFIUS, and bankruptcy rules, and the availability of tort claims and damages remedies.
