David M. Herzog brings significant federal prosecutorial experience to his trial and appellate practice. During nearly two decades with the United States Attorney’s Offices in Los Angeles and Spokane, he led teams of prosecutors as Chief of Appeals, Deputy Criminal Chief, and Deputy Chief of Violent and Organized Crimes, and served as Human Trafficking Coordinator and Project Safe Childhood Coordinator in each office. He has overseen hundreds of investigations and tried numerous complex cases ranging from international child sex tourism and human trafficking to multidefendant conspiracies and sophisticated financial and regulatory violations. Dave has also briefed and argued dozens of cases before the Ninth Circuit, developing a reputation for incisive legal analysis and clear, persuasive written advocacy. His government service has given him a deep understanding of enforcement priorities, prosecutorial strategy, and the mechanics of federal litigation—insights he now leverages on behalf of corporate and individual clients.
In his return to private practice, Dave focuses on commercial litigation and appeals, with emphases in products liability, complex torts, and white‑collar defense. He is known for his strategic judgment, command of complex factual records, and ability to distill intricate legal issues for judges and juries. He brings a disciplined, trial‑tested approach to every matter, and understands how to build, try, and defend cases from investigation through appeal.
