Scott P. Humphreys is a member of the Labor & Employment Practice in Greenberg Traurig's New Jersey office.   • Prevailed on appeal in February 2023, obtaining the reversal of an award of paid time off (“PTO”) to a former employee of a Major Hospital System who was terminated for disciplinary reasons. The lower court deemed PTO to be “wages”, but the Appellate Division reversed, concluding that PTO was not wages under New Jersey law and that the client – and employers generally – have the right to define the terms of paid leave programs and enforce well-written policies.
  • Prevailed on appeal in January 2022 on behalf of Major Hospital System, obtaining reversal of a NJ Department of Labor overtime wage determination.
  • Represented a New Jersey manufacturing company in a single plaintiff lawsuit alleging violations under the NJLAD for sexual harassment and unlawful retaliation.°
  • Representation of an employee-supervisor in litigation alleging individual liability for violations pursuant to the NJLAD.°
  • Represented an employer in a single plaintiff lawsuit alleging unlawful discrimination and violations under the Family Medical Leave Act.°
  • Contributed to the defense of an engineering company in a lawsuit alleging unlawful discrimination pursuant to the Age Discrimination in Employment Act.°
  • Assisted with and conducted pre-suit employer investigations in various industries pertaining to internal workplace discrimination, sexual harassment and retaliation complaints to ascertain potential employer liability under applicable state and federal law.°
