Perla Salgado is member of the tax and administrative litigation and amparo practice in Greenberg Traurig’s Mexico City office.

Perla has handled complex judicial matters in state and federal courts, participating in various landmark litigation proceedings and representing national and international clients from different industries, including infrastructure, tax, telecommunications, antitrust, transportation, technology, construction, real estate, and energy.

She also has experience in arbitration, mediation, and alternative dispute resolution methods in the above areas before federal (SICT, PEMEX, PROFECO, among others) and international agencies (ICC).

Perla has been recognized by Benchmark Litigation as a “Future Star” (2020 and 2021) and by The Legal 500 in Mexico as a “Recognized Individual” and “Recommended Lawyer” in dispute resolution (2021 and 2023).

Experience

  • Participation and representation of a company engaged in the preparation, preservation, packaging, and/or packing of dairy products in a lawsuit to challenge the legality of an official notice issued by the Tax Administration Service (SAT), which determined that the products taxed by such company at the 0% rate of value-added tax (VAT) should be considered taxable at the 16% rate and therefore, denied the refund of the tax credit requested.
  • Participated in the defense of a company engaged in the wholesale and retail purchase and sale of airtime and prepaid airtime cards, as well as the marketing and distribution of fixed and mobile cellular telephony devices in an amparo proceeding against the resolution of the request for administrative reconsideration of a tax credit determined by the Tax Administration Service of approximately MXN$680 million imposed on the company.
  • Participated in the defense of a global telecommunications company in a litigation to challenge the SAT’s rejection of a multimillion-peso tax refund request derived from the purchase and sale of dark fiber.
  • Participation and representation of one of the largest multimedia companies in the world in a litigation to challenge the SAT’s refusal to grant a VAT refund request and the potential imposition of a large tax credit.
  • Defense of an individual as a partner of a real estate company in Mexico against the SAT’s attempt to collect from him – as a joint and several obligor – a tax credit of approximately MXN$100 million imposed on the company.
  • Participation and representation of a company active in construction, urbanization, leasing, and promotion of real estate projects in Mexico in an amparo trial against the arbitrary and illegal closing of the complainant’s vehicular access to the property of which it is the owner.
  • Defense of a Spanish engineering and technology company with presence in 34 countries, including Mexico, in a nullity trial against the termination of a service agreement.
  • Participation and representation of a holder of the concession granted by the Ministry of Infrastructure, Communications and Transportation to build, operate, exploit, preserve, and maintain for 30 years the Palmillas-Apaseo El Grande highway, in the states of Querétaro and Guanajuato, in an administrative litigation against several acts, including the imposition of a temporary security measure consisting of the closure or suspension of works and services of a commercial inn.
  • Defense of a Spanish engineering and technology company with presence in 34 countries, including Mexico, in an arbitration before the ICC against a construction company located in Monterrey, Nuevo León, in connection with several disagreements and acts of non-compliance arising from an agreement for the construction of an industrial plant for the manufacture of tires.
  • Participation and representation of a holder of the concession granted by the Ministry of Infrastructure, Communications and Transportation to finance, design, build, operate, exploit, preserve, and maintain the Nuevo Necaxa-Ávila Camacho Highway Section and to exploit, operate, preserve, and maintain the Ávila Camacho-Tihuatlán Highway Section in an administrative litigation lawsuit where a ruling was challenged whereby it was determined that the three events notified as fortuitous cases are not applicable.
  • Participated in the representation of a company engaged in construction activities in an amparo proceeding as interested third parties for purposes of defending the legality of the construction being carried out on the property that is the subject of the controversy.
  • Participation and representation of an aerodrome with a terminal for air travel by aircraft in an amparo proceeding against the issuance and execution of a resolution by the Federal Antitrust Commission, through which several economic fines and suppression and correction orders were imposed for the alleged commission of a relative monopolistic practice.
  • Participation and representation of a pharmaceutical company in an amparo proceeding against the closing of an investigation carried out by the Federal Antitrust Commission, due to a series of commitments that were reached by third parties, without prior notification and participation of such company.
  • Defense of an individual in an amparo proceeding against a fine imposed by the Federal Antitrust Commission in an investigation proceeding initiated and developed before the Commission.
  • Defense of an individual in a nullity trial against the illegality of a fine imposed by the National Banking and Securities Commission (CNBV) for the alleged violation of the Securities Market Law.
  • Participated as counsel for a company present in Mexico, United States, Latin America, and the Caribbean dedicated to the generation and production of high-quality and sustainable raw materials and industrial products in an amparo lawsuit against the decree by which several provisions of the Federal Telecommunications Law are amended and added, through which the National Registry of Mobile Telephony Users (PANAUT) is created and several obligations for users are originated.
  • Defense of a company whose purpose is to provide consulting services in senior management of companies in an amparo lawsuit against the decree by which several provisions of the Federal Telecommunications Law are amended and added, through which the National Registry of Mobile Telephony Users (PANAUT) is created and several obligations for users are originated.
  • Participation and representation of a company engaged in the establishment and operation of specialized general cargo transportation services in a contentious administrative lawsuit in which an official notice was challenged by which the Federal Protection Environment Agency (Procuraduría Federal de Protección al Medio Ambiente) issued several fines for alleged violations of the Ley General para la Prevención y Gestión Integral de los Residuos (General Law for the Prevention and Integral Management of Waste) and imposed obligations under such law.
  • Participation and representation of major companies of the energy sector in Mexico in several amparo proceedings against the following: i) Agreement to Guarantee the Efficiency, Quality, Reliability, Continuity and Security of the National Electric System due to the Recognition of the Epidemic of Disease caused by the Sars-Cov2 virus (Covid-19) and ii) Agreement by which the Policy of Reliability, Security, Continuity and Quality in the National Electric System is issued,, issued by the National Center of Energy Control and the Ministry of Energy.
  • Defense of important companies in Mexico’s energy sector in several amparo lawsuits against the transmission methodology established in resolution number RES/066/2010 and the charges for the electric energy transmission service to be applied by the Federal Electricity Commission (Comisión Federal de Electricidad).
  • Participated in the defense of important companies of Mexico’s energy sector in several amparo proceedings against resolution number RES/1094/2020 modifying general administrative provisions that establish the terms to request the authorization for the modification or transfer of energy generation or electricity supply permits, issued by the Energy Regulatory Commission (Comisión Reguladora de Energía).
  • Participation and representation of important energy companies in several amparo proceedings against certain provisions of the Decree Amending and Adding Diverse Provisions of the Electric Industry Law.
  • Defense of important companies in Mexico’s natural gas sector in several amparo proceedings against the Emergency Directive for the Welfare of the Liquefied Petroleum Gas Consumer and Agreement number A/024/2021, issued by the Ministry of Energy and the Energy Regulatory Commission, respectively.
  • Defense of a company engaged in the design, construction, operation, and maintenance of vacation properties within the Mexican Republic in an infringement proceeding brought by the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor) for alleged violations of the Federal Consumer Protection Law.
  • Defense of a company engaged in promotional services for the sale of vacation properties within the Mexican Republic in an amparo proceeding against several acts issued by the Mexican Institute of Industrial Property, including the eventual closing of the property owned by the company.
  • Defense of an independent multimodal operation group in Mexico, Central America, and the Caribbean, focused on the handling of bulk cargo, within a bidding procedure, so that the decision issued by the Administración Portuaria Integral de Guaymas, S.A. de C.V. and the eventual assignment of the agreement remained firm and the appeal filed by one of the participants was declared unfounded.
  • Participation and representation of a company that provides maritime, fluvial, and lake transportation services of all kinds, regulated towing port services, among others, in an amparo lawsuit against the illegal awarding of an agreement with another company to provide such services in Manzanillo, Colima, as well as the approval and registration of such agreement.
  • Participation as lead counsel for an international company dedicated to the marketing, distribution, and promotion of all kinds of computer programs, video games, and accessories, products, or services directly or indirectly related thereto regarding various complaints filed by consumers before the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor).
  • Participation and representation of Uber in the legal strategy that would allow it to operate in the state of Quintana Roo, through the promotion of several amparo lawsuits against the provisions that regulate as a public service the service contracted through a platform such as Uber, generating a jurisprudence thesis regarding the nature of the client’s service (arguing that it is different from that of a “public transportation service”).
  • Defense of an international company whose corporate purpose is the import, marketing, distribution, and sale of computer equipment in several nullity, amparo, and class action lawsuits regarding the marketing of such products.
  • Participation as lead counsel of an international company engaged in the design, manufacture, industrialization, processing, purchase, sale, and distribution of materials and products and the provision of services on the marketing, distribution, and sale of software in several complaints filed by consumers before the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor).

  • Defense through the filing, follow-up, and conclusion of an indirect amparo trial in favor of a minor with various ailments and diseases so that he could be provided with medication to subsist and so the COVID-19 vaccine could be administered.
  • Participation in the processing and regularization of immigration status, recognition of refugee status, or family reunification in Mexico for several families or individuals from the Republic of Congo, Guatemala, and El Salvador.
  • Defense through the filing, follow-up, and conclusion of an action of patrimonial responsibility of the state in favor of a person who was arbitrarily sent to the police station and violated psychologically and physically.
