Mallory Cooney represents clients in government investigations, regulatory enforcement actions, internal investigations, and complex litigation matters at the trial and appellate level.

She advises businesses navigating contentious disputes regarding a variety of claims, including tortious interference, violations of covenants not to compete, theft of trade secrets, defamation, unfair competition, trademark infringement, and civil RICO. Additionally, Mallory guides clients through investigations and enforcement actions involving government agencies, commodities exchanges, and other enforcement authorities.

Mallory’s investigations and enforcement clients include individuals, broker-dealers, international futures and swap exchanges, financial institutions, and other public and private entities in highly regulated industries, inside and outside of the United States, with a focus on crypto, digital assets, and derivatives.

Mallory is committed to service and has an active pro bono practice. She has advocated for victims of human trafficking, filed amicus briefs in death penalty appeals across the country and before the United States Supreme Court, and provided legal services to victims of nonconsensual pornography (i.e., “revenge porn”) when their explicit images are distributed and displayed online without consent.

  • Represented 61 futures brokers in a multiyear investigation by the CFTC into allegations of market manipulation.°
  • Assisted with a three-part trial to successfully contest the discharge of a $600 million judgment issued by the Judicial Committee of Her Majesty’s Privy Council (U.K.).°
  • Drafted a response brief in an appeal resulting in affirmance of $4.2 million judgment by the Third District Court of Appeal.°
  • Drafted three briefs amici curiae filed in support of petitions for writ of certiorari with the Supreme Court of the United States and another filed with the Supreme Court of Idaho on behalf of capital defendants.°
  • Argued for the issuance of preliminary and permanent injunctions in cyber-harassment actions.°
