Alice Kwak advises and defends employers in high-stakes workplace disputes and day-to-day compliance matters, with nearly a decade of experience serving emerging, national, and multinational companies. Her practice combines deep California employment law experience with counseling on employment matters across multiple jurisdictions. She works closely with human resources professionals, in-house counsel, and business leaders to navigate personnel decisions, develop workplace policies, and manage employment risks.

Much of Alice’s advisory work centers on wage and hour compliance, including worker classification, meal and rest period practices, and audits of timekeeping policies designed to reduce litigation exposure before claims arise. She also guides employers through leaves and accommodations, discipline, terminations, and reductions in force, and drafts and negotiates executive employment agreements, separation agreements, handbooks, commission structures, and arbitration frameworks. On the transactional side, she handles employment due diligence for mergers and acquisitions and advises on traditional labor issues such as collective bargaining agreements, memoranda of understanding, and labor-related contract provisions.

Alice conducts sensitive internal investigations involving harassment, discrimination, and executive misconduct, delivering factual findings and remedial recommendations directly to C-suite and HR stakeholders.

Alice represents employers in individual, class, and PAGA actions in state and federal court, arbitration, and before administrative agencies. Her experience includes case strategy, depositions, motion practice, arbitration hearings, and mediations. She has second-chaired a jury trial resulting in a full defense verdict and a bench trial involving complex California Education Code claims. She also has experience with executive departures, restrictive covenants, and cross-border employment disputes. Her litigation experience informs both her practical counseling and her approach to resolving disputes.

Before entering private practice, Alice served as a judicial extern to Justice Goodwin H. Liu of the Supreme Court of California and Magistrate Judge Laurel Beeler of the United States District Court for the Northern District of California. She has co-authored client advisories on California labor law developments and contributed analysis of emerging employment issues for legal and business publications.
