Competition: Investigations, Merger Control & Antitrust Litigation
Greenberg Traurig’s Antitrust Litigation & Competition Regulation Practice advises on the antitrust aspects of mergers, acquisitions and joint ventures, including handling complex multi-jurisdictional merger control filings. We also work on the compliance side of this complex topic. We work with clients to craft antitrust compliance programs, oversee internal investigations, represent clients in government antitrust investigations, and handle trial and litigation matters when necessary. Leveraging our deep experience in the sector, our attorneys provide strategic legal oversight to all clients impacted by antitrust issues on a global basis.
Our firm has led key matters and proceedings in antitrust matters before the competition authority in Mexico, as well as before specialized courts in the matter and the Supreme Court of Justice of the Nation, providing comprehensive advice and specialized representation in this matter.
Our Antitrust Litigation & Competition Regulation attorneys have broad experience representing companies and associations that are confronting cartel and abuse of dominance probes and in designing and implementing defense strategies in response to investigations of alleged monopolistic practices (absolute and relative). We handle early closure of procedures via the Leniency Program (in the case of cartels) and the presentation of commitments (in cases of abuse of dominance), efficiently reviewing substantial volumes of data with our technology and know-how. Our team has obtained opinions from the competition authority to participate in bids and formal opinions on matters of interpretation of the law. We have managed procedures to declare a lack of effective competition, the existence of substantial market power by an economic agent and the declaration of an essential facility.
