Tracy L. Gerber is Co-Managing Shareholder of Greenberg Traurig’s West Palm Beach office, Co-Chair of the firm’s Broker-Dealer Securities Litigation Practice, and a member of the Executive Committee of the firm’s Global Litigation Practice. A trusted advisor to leading financial institutions, public and private companies, and private equity firms, Tracy is the lawyer clients turn to when facing their most complex and high-stakes employment problems; disputes where legal, regulatory, and reputational risks often converge.
Tracy has tried more than 100 arbitrations to final award in FINRA, JAMS, and AAA, with many involving testimony from senior executives. She brings a unique ability to manage these sensitive matters with precision, understanding the business pressures executives face, their limited availability, and the need for focused, efficient preparation. Tracy has also jointly represented companies and their top leadership in employment disputes that demand discretion and strategic coordination.
Tracy regularly defends against claims alleging wrongful termination, whistleblower retaliation under SOX and state whistleblower protection statutes, U5 defamation, discrimination, sexual harassment, hostile work environment and wrongful termination arising from internal investigations and regulatory inquiries. Tracy has substantial cross-over experience in the regulatory and sales practice arena, having handled numerous SEC, FINRA, and state regulatory investigations and enforcement proceedings, as well as customer arbitrations. She is particularly skilled in navigating matters involving complex privilege waiver considerations, where terminations arise from internal investigations and companies must weigh whether (and how broadly) to waive privilege in order to defend themselves.
Tracy also has wide-ranging experience with court actions related to the enforcement of arbitration agreements (including cases involving the EFAA) and challenges to arbitral awards, seeking to give clients a strategic edge in protecting arbitration rights and outcomes. Known for her ability to manage parallel proceedings (employment, regulatory, and customer matters) Tracy ensures strategies are aligned and risk-sensitive. She also advises clients proactively through pre-dispute mediation and agency charges before the EEOC, OSHA, and similar bodies.
Tracy developed Greenberg Traurig’s national arbitrator database, consulted on arbitrator selection for more than 1,000 panels, and previously served as a FINRA arbitrator. A sought-after speaker and faculty member at the Securities Industry Institute at the Wharton School, Tracy is widely regarded as a thought leader in securities arbitration and employment litigation.
