Jennifer Junger

Jennifer Junger focuses her practice on commercial litigation. She handles cases in both federal and state court throughout all phases of litigation. Jennifer’s experience includes working on federal cases involving indemnification claims waged against mortgage originators that sold residential mortgages to multi-national banks; the breach of an alleged oral contract asserted by a broker claiming to be owed a commission on a major corporate merger; a Florida Deceptive and Unfair Trade Practices Act claim brought in a product labeling class action; and a Telephonic Consumer Protection Act class action brought against a major shipping company and its call centers.

  • Defended 10 loan originators and sellers in the RFC and ResCap Liquidating Trust Litigation. More than 80 suits comprising the consolidated action were brought by the successor to one of the largest private purchasers of mortgage loans, seeking repurchase and indemnification arising out of the sale of billions of dollars-worth of mortgage loans, which were pooled by the plaintiff into mortgage-backed securities.°
  • Represented former officers and directors of an educational institution, in defense of charges brought by a trustee in bankruptcy, which is represented the creditors of the failed college. Client owned and operated many for-profit schools across multiple states and, as such, was one of the largest operators of for-profit colleges in the country. The lawsuit sought $150 million and alleged mismanagement on the part of the officers and directors.°
  • Represented beverage manufacturer and distributor, in defense of a national class action consumer fraud and deceptive advertising case, which involved claims based on alleged misleading statements on the packaging and marketing materials of its coconut water beverages. Obtained an order denying class certification and dismissal of the entire case on behalf of client.°
  • Represented mortgage lending affiliates for major homebuilders in defense of multiple lawsuits brought by the FDIC as Receiver for AmTrust Bank relating to alleged loan defects relating to separate mortgage loan portfolios. Clients settled the cases at mediation for a small fraction of what was being sought, well below settlements obtained by other defendants in identical cases brought across the country and below estimated costs of defense to trial.°
  • Assisted on a workplace sexual harassment case under Title VII, resulting in summary judgment in the client’s favor.°
