- Member of two-person Greenberg Traurig trial team representing the primary beneficiary of the Beverly C. Morgan Family Trust in a trial in Orange County Superior Court over a petition against two professional fiduciaries for breaches of fiduciary duty and surcharges, and the fiduciaries’ petitions of their accountings. After a year-long trial, the court issued a landmark 247-page decision (i) denying the fiduciaries’ petitions for approval of their accountings; (ii) awarding the primary beneficiary breach of fiduciary damages (including damages for slander per se) totaling almost $1.7 million, plus interest, (iii) ordering the fiduciaries to pay the Trust almost $2.3 million in additional damages/surcharges, plus interest, and (iv) imposing punitive damages of more than $810,000. Thereafter parties (and the fiduciaries’ bonding company) settled for $11.45 million with our clients’ motion for seven-figure attorneys’ fees and six-figure cost bill under submission.
