Mark Furnish focuses on health care law, government relations, and public policy matters. With more than 25 years of experience, he guides clients through complex regulatory processes.

Mark represents clients across the health care industry and in particular long-term care providers, hospitals, nursing homes, and private physician practices. His practice encompasses a broad range of legal issues related to health facility planning and development, licensure, telehealth, scope of practice, and health facility surveys. In addition, he also provides counsel on policy positions and public affairs strategies, and develops and implements legal, legislative, intergovernmental, regulatory, and media strategies.

Mark’s government service has greatly informed his legal practice. He served as Director of the Center for Long Term Care Licensure, Planning and Finance at the New York State Department of Health, and also held positions as Director of Health Facility Planning and Development, Legal Affairs, and Director of the Center for Health Care Policy and Development within the same department. He also served as chair of the New York State Continuing Care Retirement Communities (CCRC) Council. These roles provided Mark with deep insights into health care regulation and policy implementation – with a special emphasis on Certificate of Need (CONs), licensure, New York State Public Health and Health Planning Council (PHHPC) matters, telehealth regulatory questions, health facility survey concerns, value-based payment (VBP) models, and antitrust considerations for health care systems.

Earlier in his career, Mark served as chief counsel to multiple New York state senators, including those in leadership roles on key committees such as the Senate Health Committee and the Senate Committee on Consumer Protection, Investigations, and Government Operations.

Mark has been involved in the development and passage of significant legislation in New York, particularly in civil rights and health care decision-making. He continues to apply this background in his current legal practice, assisting clients with legislative strategies and public policy initiatives.
