Jonathan H. Claydon focuses his practice on complex litigation and class action defense with broad experience representing clients in the financial services industry. He helps to lead a national team of attorneys across Greenberg Traurig’s offices defending financial institutions in a variety of consumer and business matters and has served as lead counsel in matters nationwide. He advises and defends a wide range of financial institutions, including national and regional banks, credit unions, mortgage lenders, and broker-dealers in high-stakes litigation arising from lending practices, retail banking operations, regulatory compliance, and fraud-related matters such as Ponzi schemes. Jon has deep experience with complex financial cases involving issues arising under the Bank Secrecy Act and related regulatory issues.

  • Represented a financial institution in a mobile banking class action, seeking certification of a national class. Obtained dismissal of the putative class action based on failure to state a claim and on preemption grounds.
  • Represented a financial institution in a complex Ponzi scheme matter in Arizona state court alleging losses exceeding $30 million arising out of real estate investments. Obtained full summary judgment victory and expanded case law on lack of receiver standing to bring aiding and abetting claims.
  • Represented a financial institution on a nationwide basis in putative class actions arising out of the COVID era Paycheck Protection Program. Prevailed on motions to dismiss or motions to compel arbitration in all matters.
  • Represented financial institution in a Ponzi scheme matter alleging in Southern District of Florida alleging $10 million in investor losses from frozen food receivables business. Obtained dismissal with prejudice after two rounds of motion to dismiss briefing.
  • Represented financial institutions in overdraft class action matters, seeking certification of both statewide and national classes.
  • Represented a financial institution in putative class action asserting secondary violations of the Oregon Securities statute.
  • Represented an automobile manufacturer in putative class action alleging violation of services agreements. Prevailed on motions to compel individual arbitration.
  • Represented a company in connection with a putative class action relating to an alleged data breach. Class certification denied.
  • Represented an airline company in a putative class action alleging breaches of contract and unjust enrichment for failure to disclose hidden fees. Obtained dismissal with prejudice.
  • Represented a financial services company in relation to a Ponzi scheme associated with the purchase and sale of USDA business and industry loans in the secondary market. Recovered more than $120 million dollars from businesses and individuals connected with the fraud.
