Allison Kahn is board certified in labor and employment law by The Florida Bar, a distinction held by only about 200 lawyers in the state and one that reflects testing and peer evaluation in her practice area. As Chair of the West Palm Beach Labor & Employment Practice, she defends and counsels employers of all sizes in health care, hospitality, banking, telecommunications, and education, appearing in state and federal court, in arbitration, and before administrative agencies. Employers hire her to try discrimination, harassment, retaliation, and wage and hour cases, and with the goal of keeping workplace decisions from becoming litigation in the first place. She has taken employment cases through jury trial, arbitration, and appeal.

Much of Allison’s practice involves defending employee claims of discrimination, hostile work environment, and retaliation based on race, religion, national origin, sex, age, disability, and other protected characteristics under the Florida Civil Rights Act, Title VII, the Age Discrimination in Employment Act, and the Americans with Disabilities Act. She regularly appears before the U.S. Equal Employment Opportunity Commission, the U.S. Department of Labor, the Florida Commission on Human Relations, and county fair employment practice agencies. Management clients also turn to her for advice and defense under the Whistleblower Protection Act and the Family and Medical Leave Act.

On the wage and hour side, Allison has completed more than 300 employee pay classification audits assessing exempt and nonexempt status under overtime laws. That work informs her defense of misclassification claims and collective actions under the Fair Labor Standards Act. She also litigates joint employment questions and disputes over employee versus independent contractor classification, and she structures internship programs to comply with wage and hour requirements.

Allison’s practice extends to prosecuting violations of noncompetition agreements, defending schools against sex-based discrimination in education claims under Title IX, and defending businesses and public accommodations against access discrimination claims, including website accessibility. She tries grievances under collective bargaining agreements in a range of arbitration forums.

  • Testified as an expert on the Americans with Disabilities Act and Fair Housing Act regarding the number and nature of parking spaces required in a parking lot shared by a condominium and a place of public accommodation.°
  • Represented a securities company at arbitration before the Financial Industry Regulatory Authority in an employee’s claims of race, national origin, and disability discrimination and obtained dismissal for employee misconduct, along with subsequent order of dismissal from a federal district court finding the employee’s misconduct made the agreed-upon arbitration tribunal unavailable and foreclosed employee’s claims in court.°
  • Represented a college accused of wage discrimination based on an employee’s race and color and obtained dismissal of Title VII claims for the employee’s discovery misconduct and summary judgment on Florida Civil Rights Act counts and 42 U.S.C. § 1981 claim.°
  • Obtained preliminary injunction in favor of a hospital and against a physician in violation of noncompetition agreement.°
  • Defeated class certification in an ERISA claim.°
  • Represented a hospital in a four-day jury trial, and obtained complete defense verdict, in a case where an employee sought $2 million for alleged whistleblower retaliation and disability discrimination.°
  • Represented a medical center, and prevailed, at a two-day evidentiary hearing before Florida’s Division of Administrative Hearings after an employee appealed a Florida Commission on Human Relations’ decision finding “no cause” to believe sex, age, race, or national origin discrimination occurred.°
