Lindsay Proskey represents employers in individual and multi-claimant employment litigation, with a focus on trial and agency proceedings. She has experience defending clients in cases involving allegations of discrimination, disparate treatment and impact, harassment, retaliation, and wage and hour violations under federal and state law. Her practice includes claims based on race, religion, national origin, sex, sexual orientation, disability, age, gender, and protected leave status.

In addition to these claims, Lindsay handles other employment-related claims, including breach of contract, breach of the implied covenant of good faith and fair dealing, fraud, defamation, assault and battery, negligence, intentional infliction of emotional distress, and vicarious and joint employer liability. Lindsay also assists clients in responding to Department of Labor investigations, audits, and agency inquiries.

Lindsay represents clients in mediations, arbitration hearings, and trials, and has defended employers in jury trials resulting in unanimous defense verdicts, as well as arbitration hearings. Her practice spans multiple jurisdictions, including Illinois, Arizona, and Texas.

  • Secured summary judgment for employer on age discrimination and breach of contract claims; arbitrator awarded over $400,000 in attorneys’ fees and costs and found in favor of client regarding a $2M ownership dispute.
  • Successful defended an employer against claims based on age discrimination, retaliation, and wrongful discharge in a 4-day jury trial in Las Cruces, New Mexico. The jury deliberated for two days and returned a unanimous defense verdict.
  • Defended employer in labor arbitration involving unreported motor vehicle accident; identified third-party witness using dash cam footage and skip trace, resulting in accident victim testifying at the hearing.
  • Settled case alleging disability discrimination, retaliation, and violations of the Texas Labor Code.
