Marissa Banez focuses on products liability defense, which includes asbestos, tobacco and black lung litigation, as well as medical devices and pharmaceuticals actions, in state and federal courts throughout the country, representing Fortune 500 and Fortune 100 companies. In asbestos matters, she has represented from complaint through trial (many times as lead counsel) major manufacturers, contractors and distributors of asbestos-containing products in both personal injury and property damage cases.  In addition, she regularly litigates as appellate counsel in residential mortgage foreclosures, having won the vast majority of her appeals and obtaining multi-million-dollar settlements.  She also has represented a Fortune 500 company in several premises liability actions.

Marissa has worked, pro bono, with The Veterans Consortium as appellate counsel before the U.S. Court of Appeals for Veterans Claims and with New York City’s Advocates for Children, assisting parents with children that have learning disabilities.  She also serves as a mentor for the Leadership Council for Legal Diversity.

Marissa has published an article in the New York Law Journal and was a presenter for the WestLegalEdCenter webinar on issues relating to the standing of unnamed class members in class action litigation.

  • Won six consecutive appeals in mortgage foreclosure cases before the Supreme Court of the State of New York, Appellate Division – Second Department in 2020 alone.
  • Responsible for the entire New Jersey personal injury asbestos litigation docket involving all phases of litigation in the representation of Robert A. Keasbey Co. from 2005 to 2011.
  • Fuller v. Shinseki (United States Court of Appeals for Veterans Claims, Docket No. 10-3314, 2011): As appellate counsel, drafted brief that resulted in counsel for the United States Department of Veterans Affairs agreeing to remand case without further briefing or argument.
  • Jackson v. Celotex Corp. (Superior Court of New Jersey, Hudson County): As lead counsel, obtained defense verdict following a two-week trial of asbestos personal injury action.°
  • Responsible for the entire New Jersey personal injury asbestos litigation docket involving all phases of litigation in the representation of United States Mineral Company and Pittsburgh Corning Corporation from 1991 to 2000.°
  • Represented the “Wellington Defendants” involving all phases of litigation as lead medical counsel in personal injury asbestos cases in California and New Jersey.°
