Molly Littman-Johnson focuses her practice on trademark, copyright, trade dress, anti-counterfeiting, false advertising, and unfair competition matters, with an emphasis on the protection, enforcement, and defense of intellectual property rights. Molly has experience representing clients in federal courts across the country, as well as before the Trademark Trial and Appeal Board (TTAB) of the United States Patent and Trademark Office (USPTO). Her experience also includes helping clients address growing threats to intellectual property on the internet, including domain name disputes, UDRP complaints, and take-downs of infringing content on e-commerce and social media platforms.

In addition to her intellectual property litigation practice, Molly advises on brand management and protection in the United States and abroad. She represents clients across a wide range of industries, including restaurant and hospitality, consumer goods, e-commerce, entertainment, fashion and retail, gaming, financial services, medical devices, pharmaceuticals, software, technology, and blockchain and digital assets.

Experience

  • Represented luxury hotel client in trademark infringement and dilution lawsuit; case resolved in favor of client prior to trial.
  • Represented financial technology company in trademark infringement lawsuit; case resolved in favor of client prior to trial.
  • Represented consumer goods client in trademark opposition before the Trademark Trial and Appeal Board; prevailed on likelihood of confusion claim and opposed application denied registration.
  • Represented large fashion design client in counterfeiting lawsuit against online counterfeiting ring; case successfully resolved in favor of client prior to trial.°
  • Represented defendant in copyright infringement lawsuit through four-day trial; jury found in favor of statute of limitations defense and awarded plaintiff only two percent of amount requested; court denied plaintiff’s motion for attorneys’ fees as prevailing party.°
  • Defended non-profit corporation as lead counsel in Trademark Trial and Appeal Board proceeding after large company sought to cancel client’s registered design trademarks and sought to oppose client’s design mark applications; case successfully resolved in favor of client prior to trial.°
  • Successfully represented numerous clients in enforcing and defending federal trademark registrations and applications in Trademark Trial and Appeal Board proceedings.°
  • Successfully represented clients in various industries (including fashion, health care, food and beverage, and hospitality) to implement national trademark enforcement programs and enforce trademarks and copyrights against infringers online and on social media.°
