Brian Pantaleo has a wide range of experience in real estate and commercial litigation. Brian started his career as a general commercial litigator. But currently he focuses on real estate litigation. Brian represents banks, lenders, developers, and mortgage companies in disputes involving mortgages and real property and financial services. He also advises and defends businesses against various statutory claims, including the Real Estate Settlement Procedures Act, the Truth in Lending Act, the Fair Debt Collections Practices Act, the Fair Credit Reporting Act, and the Telephone Consumer Protection Act, as well as other state consumer protection statutes.

Brian is licensed in Florida, New Jersey, and New York. He tries cases in all three jurisdictions.

  • Argued one, and briefed two, of the four cases in the New York Court of Appeals’ omnibus decision Freedom Mortg. Corp. v. Engel, 37 N.Y.3d 1 (2021), which changed foreclosure law in New York State.
  • Trial verdict for investor client in fourteen-year title/mortgage fraud dispute involving property in Passaic County, New Jersey.
  • Prevailed before the Eleventh Circuit Court of Appeals in appeal involving seminal issue interpreting Real Estate Settlement Procedures Act, and its implementing regulations.
  • Trial for large retail client in wrongful detention case in Cape May County, New Jersey.
  • Victory in Zoom trial in a lost note foreclosure case in Broward County, Florida
  • Summary judgment in favor of investor mortgagee client, which was affirmed on appeal, in dispute over hazard insurance proceeds resulting from sinkhole damage in Pinellas County, Florida.
