Shira Yoshor is an experienced employment lawyer, regularly representing management in all aspects of employment law. Her clients range from major global corporations to smaller, newer companies, including those entering the U.S. market for the first time. She counsels employers on workplace issues and drafts documents from employment agreements, handbooks, and policies to separation agreements and disclosures. She investigates and litigates whistleblower, discrimination, and retaliation claims, including some of the most sensitive harassment claims against high-level executives. She drafts, enforces, and defends restrictive covenants and helps employers protect their trade secrets. She also helps employers deal with wage and hour and classification matters from audits to defending class and collective actions.

In recent years, Shira has focused on advising and counseling employers with their most challenging employment issues. She is a strategic partner as her clients deal with difficult accommodation and termination issues. She regularly advises boards of directors and guides them through sensitive executive terminations.

  • Pursued claims against former employees and their new employers for violating nondisclosure, nonsolicitation and noncompete agreements in multiple jurisdictions for a national leader in landscaping services, and defended similar claims successfully, defeating applications for injunctive relief and resulting in the termination of former employees who took positions in violation of their restrictive covenants.
  • Defended foreign companies and their subsidiaries from purported collective actions claiming wage and hour violations under the Fair Labor Standards Act and state statutes.
  • Provided strategic advice on labor and employment issues for complex transactions, including restructuring through bankruptcy. 
  • Obtained judgment as a matter of law on claims of discrimination and retaliation in the Southern District of Texas for a global e-commerce company.
  • Advised global and small companies on reductions in force, investigations, requested accommodations, and terminations.
  • Investigations of sensitive harassment claims, including presentations to boards and high-ranking executives.
  • Served as special master in Equal Pay Act case, dealing with difficult admissibility questions in the United States District Court for the Eastern District of Pennsylvania.
  • Appointed as guardian ad litem to a plaintiff suing the City of Philadelphia in the United States District Court for the Eastern District of Pennsylvania after conviction was overturned. 
  • Obtained complete dismissals of claims of discrimination, retaliation, and whistleblowing.
  • Counsels and trains employers on managing workplace issues and preventing lawsuits, including anti-harassment and respectful workforce training.
  • Drafts, enforces and defends non-competition, non-solicitation, non-disclosure, and nondisparagement agreements.
  • Audits regarding proper classification of employees under the FLSA.
  • Defends employers in DOL actions and private actions under the FLSA regarding purported misclassification of employees and alleged failure to pay overtime and recently defeated conditional certification of a class making claims under the FLSA.
  • Obtained complete judgment in favor of property owners to clear title.
  • Obtained affirmation of multimillion-dollar judgment in a breach of contract for sale of partnership interest.
  • Obtained judgments for property owners in condemnation cases.
  • Resolved claims of trade secret misappropriation.
