Nigamnarayan Acharya

Nigam Acharya focuses his intellectual property law practice on patent and trademark matters, with an emphasis on life sciences and pharmaceuticals. His practice areas include both domestic and foreign patent and trademark prosecution, as well as conducting strategic analysis and counseling for domestic and international portfolio development, management, enforcement, and licensing. With over 19 years of experience, Nigam has prosecuted hundreds of patents and argued before the Federal Circuit Court of Appeals, multiple Federal district courts, and the Patent Trial and Appeal Board (PTAB) as lead counsel in patent and trademark litigation.

Nigam also advises companies on complex technology transactions, including structuring and negotiation of licenses, and distribution agreements. Prior to joining GT, Nigam gained experience as a board member of a company where he worked with company management to grow and eventually sell the company after eight years.

Nigam’s pharmaceutical experience builds on his research in biophysical chemistry, where he studied thermodynamic parameters of protein-nucleic acid interactions. With in-depth knowledge in this area, Nigam is uniquely positioned to counsel pharma and chemical companies in securing and monetizing patents and litigating related disputes.

  • Argued and obtained a reversal of a Trademark Trial and Appeal Board’s decision to refuse registration of a mark due to likelihood of confusion with a registered mark. The precedent setting case clarified the use of third-party registrations to show the weakness of a mark in the likelihood confusion analysis. Juice Generation, Inc. v. GS Enterprises, LLC, Case No. 14-1853 (Fed. Cir., July 20, 2015).°
