Alejandro Ostos Fulda is a shareholder in the Mexico City office. He focuses his practice on civil and commercial litigation, constitutional litigation (Juicio de Amparo), administrative litigation (i.e., litigation relating to taxation, real estate, intellectual property, public procurement, regulatory affairs, etc.), domestic and international arbitration, and bankruptcy and reorganization proceedings.

Alejandro represents corporations and individual plaintiffs and defendants in complex proceedings in federal and state courts throughout Mexico, as well as in arbitration forums. Likewise, he focuses his litigation practice on contractual disputes, business torts, breach of fiduciary duty, claims involving violations of intellectual property rights, trade secret misappropriation, government contracts, and civil liability.

In addition, he has deep experience with constitutional litigation, including disputes involving the constitutionality of laws, regulations, and administrative acts, and the violation of civil rights and liberties before federal courts and the Mexican Supreme Court.

He also represents real estate owners, trust managers, and real estate investment funds in a wide variety of matters, including litigation, commercial lease disputes, leasing of office, retail, and industrial spaces, construction-related disputes, and administrative proceedings, lending transactions, and disputes involving state and federal court litigation.

For several years Alejandro has taught as a graduate law professor at several of Mexico City’s most prestigious law schools, including Escuela Libre de Derecho and Universidad Panamericana, and has been a lecturer in law in many different forums on subjects including constitutional law, intellectual property disputes and remedies, novel case law, and interpretation of civil and commercial statutes.

He has also counseled and defended banking institutions from claims involving banking transactions.

Capabilities

Experience

  • Advised and represented major U.S. potato-growing organizations in several lawsuits in Mexico that were ultimately decided by the Mexican Supreme Court, ending a decades-old prohibition on U.S. potato imports.° 
  • Counseled a multinational car maker in settling and resolving a dispute arising from a multimillion-dollar tax credit that had been assessed by the Mexican Tax Authorities.° 
  • Represented a transnational corporation in litigation involving a former manufacturer for breach of trade secrets and payment of damages.° 
  • Negotiated and resolved disputes with the Mexican federal government on behalf of a Mexican infrastructure developer that resulted in a price adjustment.° 
  • Achieved an award for damages for a concession holder in a civil litigation brought against the Mexican federal government involving breach of concession title conditions.° 
  • Assisted a global corporation in dealing with the effects of bankruptcy proceedings filed by a supplier critical to its Mexican car manufacturing operations.°
